Small Batch Seller Terms

These Seller Terms apply to anyone who lists or sells goods through Small Batch. Last updated: June 23, 2026.

1. Independent seller status

Small Batch is a digital marketplace that helps independent sellers connect with local buyers. Small Batch does not make, package, store, inspect, test, label, deliver, or guarantee any seller's goods. You are an independent seller. You are not an employee, agent, partner, franchisee, or representative of Small Batch.

2. Approved goods only

You agree to list and sell only goods that you are legally permitted to sell under your applicable state and local regulations. This includes, where applicable, cottage-food laws, homemade-food laws, food-business rules, labeling requirements, licensing requirements, permit requirements, tax rules, and any local health department rules. You are solely responsible for determining whether your goods are approved for sale in your location.

3. Seller responsibility

You are solely responsible for:

  • The legality of your goods
  • Product safety
  • Ingredients and allergen disclosures
  • Labeling and packaging
  • Listing accuracy
  • Pricing and availability
  • Buyer communication
  • Fulfillment
  • Refunds, cancellations, and customer issues
  • Taxes, permits, registrations, and licenses
  • Compliance with all applicable laws and regulations

4. Listing accuracy

You agree that all product listings, photos, descriptions, ingredients, allergen information, prices, quantities, and fulfillment details you provide will be accurate, complete, and not misleading. You may not list goods that are prohibited, restricted, unsafe, mislabeled, falsely advertised, or not approved for sale under your applicable state or local rules.

5. Food and allergen responsibility

You understand that food products may carry risks, including allergen, contamination, spoilage, handling, storage, and consumption risks. You are solely responsible for preparing, packaging, storing, labeling, and providing your goods in a lawful and safe manner. Small Batch does not verify ingredients, allergens, food safety practices, kitchen conditions, permits, or compliance status.

6. Buyer relationship

Any sale made through Small Batch is a transaction between you and the buyer. You are responsible for fulfilling the order and resolving any buyer issues related to your goods, including quality concerns, missing items, incorrect listings, refunds, cancellations, illness claims, allergen issues, or other product-related disputes.

7. Marketplace review and removal

Small Batch may review, pause, remove, or reject any seller account, product listing, or order at any time if Small Batch believes the seller, product, or listing may violate these Terms, applicable law, marketplace rules, or buyer trust standards. Small Batch is not responsible for losses caused by removed listings, paused accounts, rejected products, or marketplace access decisions.

8. Assumption of seller risk

You use Small Batch at your own risk. You are solely responsible for your goods, business activity, and legal compliance. Small Batch makes no guarantee that your goods are legal to sell, that buyers will purchase your goods, or that participation in the marketplace will generate income.

9. Indemnification

You agree to defend, indemnify, and hold harmless Small Batch, its owners, operators, employees, contractors, and affiliates from any claims, losses, damages, liabilities, costs, penalties, fees, or expenses arising from: your goods; your listings; your food preparation, packaging, labeling, storage, fulfillment, or delivery; your communications with buyers; your violation of these Terms; your violation of any law or regulation; or any claim that your goods caused injury, illness, allergic reaction, property damage, financial loss, or other harm.

10. Agreement

By creating a seller account, listing goods, or selling through Small Batch, you agree to these Seller Terms.
